General Terms and Conditions
ProCinema Online Shop, Swiss Association for Cinema and Film Distribution
1 Scope of Application
These general terms and conditions (hereinafter T&C) apply to the purchase of cinema vouchers in the online shop of ProCinema, Swiss Association for Cinema and Film Distribution, Bern (UID CHE-106.783.890; hereinafter ProCinema) by its contractual partners (hereinafter customers).
Only the T&C of ProCinema apply. ProCinema reserves the right to change the T&C. The version of the T&C valid at the time of ordering is decisive.
2 Subject Matter of Contract and Offer
The subject matter of the contract is the purchase of cinema vouchers in the ProCinema online shop. The offer is directed at customers with a place of residence / registered office in Switzerland and the Principality of Liechtenstein. Deliveries are made exclusively to addresses in Switzerland and the Principality of Liechtenstein
The offer is valid as long as it is visible in the online shop.
3 Cinema Vouchers
The voucher entitles the holder to obtain one ticket, valid for regular cinema screenings in all cinemas in Switzerland registered with the Federal Office of Culture. Excluded are special formats (e.g. 4DX, IMAX), exclusive seating areas (e.g. Deluxe, box seats, premium seats), special screenings (e.g. live events, opera), and additional services such as 3D glasses or catering. The vouchers are valid for all screenings within the printed validity period, including premieres, Saturdays, Sundays, and public holidays.
4 Validity Period of Cinema Vouchers
Cinema vouchers are valid for 10 years from the date of purchase. The actual validity period is printed on the voucher. It is binding.
Unredeemed cinema vouchers cannot be exchanged. Lost cinema vouchers will not be replaced.
5 Order and Contract Conclusion
The contract is concluded upon receipt of the online order by ProCinema. The customer receives a confirmation by email.
6 Prices and Payment Conditions
Prices and payment conditions are based on the conditions displayed and valid in the online shop at the time of ordering.
Prices are in Swiss Francs and, where legally required, include VAT.
Payments must be made in Swiss Francs. Selected credit cards, debit cards and TWINT are accepted as payment methods. From a certain order quantity, orders are processed on invoice. The payment methods available for each order are displayed in the online shop.
7 Inappropriate Content
The customer has the option to personalize gift vouchers with individual texts or designs.
The customer undertakes to use only content that is legally permissible and does not violate public decency. In particular, the following are prohibited: content of an insulting, discriminatory, defamatory or otherwise offensive nature; depictions that glorify violence or are pornographic or sexually inappropriate; content that violates legal provisions, the rights of third parties (in particular copyright, trademark or personality rights) or other protective rights; political or religious messages that are likely to offend or provoke others. ProCinema and its processing and fulfillment partners are entitled to reject orders with impermissible content or to cancel orders that have already been accepted.
The customer bears sole responsibility for the content provided. ProCinema assumes no liability for legal violations or damages arising from the personalization.
ProCinema is entitled to shorten or modify content insofar as this is necessary to ensure compliance with the above provisions.
By submitting personalized content, the customer warrants that they possess the necessary rights and that no third-party rights are infringed.
8 Registration and Data Protection
No registration is required to order in the online shop. ProCinema uses the data provided for processing the order exclusively in connection with the offer of cinema vouchers.

10 Applicable Law and Jurisdiction
Swiss law applies.
The exclusive place of jurisdiction is Bern, Switzerland.
